Dutch draft GDPR implementation act sent to House of Representatives

On 13 December 2017, the Dutch Minister for Legal Protection Sander Dekker sent the draft GDPR Implementation Act to the House of Representatives. The implementation act will cover the items that the GDPR leaves for EU member states to handle, such as specific rules on the processing of special categories of personal data (e.g. health data), important exceptions to the GDPR’s applicability, and matters relating to the embedment into administrative law. The act will formally withdraw the Dutch Data Protection Act (Wet bescherming persoonsgegevens). The draft is ‘policy neutral’ – which means that it will not unnecessarily deviate from the current legal framework under the Dutch Data Protection Act.
