In het bijzonder in complexe en grensoverschrijdende conflicten biedt, arbitrage geschillenbeslechting op maat. Steeds vaker kiezen partijen voor arbitrage, zodat zij zelf gespecialiseerde arbiters kunnen aanwijzen en de plaats van arbitrage en procesregels kunnen bepalen. Het arbitrageteam van Houthoff heeft een internationale focus en houdt zich als een van de weinige in Nederland fulltime bezig met arbitrage. Het arbitrageteam staat multinationals, financiële instellingen, overheden en staatsbedrijven bij in complexe en omvangrijke commerciële arbitrages en investeringsarbitrages. Het arbitrageteam treedt ook regelmatig op in zaken bij de gewone rechter die verband houden met arbitrage, zoals de tenuitvoerlegging van arbitrale vonnissen en de vernietiging van arbitrale vonnissen. Een aantal van onze specialisten wordt met regelmaat ook benoemd als arbiter of secretaris.

Onze expertise binnen de arbitragepraktijk
Arbitrages betreffen vaak zeer sectorspecifieke geschillen. Het arbitrageteam werkt dan ook nauw samen met onze specialisten op het gebied van onder meer financieringen, mededingingsrecht en aansprakelijkheidsrecht. Het arbitrageteam vertegenwoordigde cliënten al succesvol in een groot aantal arbitrages onder verschillende reglementen en arbitrage-instituten, zoals onder de UNCITRAL Rules en bij de International Chamber of Commerce (ICC), het International Centre for Settlement of Investment Disputes (ICSID), het Nederlandse Arbitrage Instituut (NAI) en het London Court of International Arbitration (LCIA).
Internationale investeerders die grote verliezen hebben geleden, kunnen onder bepaalde voorwaarden bescherming krijgen onder de verschillende bilaterale investeringsverdragen (BITs) die door Nederland met andere staten zijn aangegaan. Zij betrekken onze arbitragespecialisten als "go-to counsel" om hun vennootschappen zo te structureren dat er BIT-bescherming bestaat en/of om hun geleden verlies terug te vorderen in een zogenaamde investeringsarbitrage.
Daarnaast mogen cliënten rekenen op adequaat advies over en bijstand bij de erkenning en tenuitvoerlegging van (internationale) arbitrale vonnissen. Het arbitrageteam heeft een zeer succesvol track record in grote vernietigings- en tenuitvoerleggingsprocedures. Naast het succesvol voeren van (arbitrage)procedures, is het belangrijk dat arbitrage vooraf wordt gegaan van duidelijke afspraken. Houthoff heeft ruime ervaring met het opstellen van en het onderhandelen over arbitrageclausules.
